立院初審 提高陸漁船擅入罰鍰

立法院內政委員會今天初審通過台灣地區與大陸地區人民關係條例部分條文修正草案，提高中國大陸漁船違法進入台灣地區限制或禁止水域罰鍰。

現行規定，中國大陸船舶未經許可進入台灣地區限制或禁止水域，主管機關得逕行驅離或扣留船舶、物品、留置其人員或為必要防衛處置。經扣留者，得處船舶所有人、營運長或船長、駕駛人新台幣100萬元以上1000萬元以下罰鍰；若為漁船，處5萬元以上50萬元以下罰鍰。

為嚇阻中國大陸漁民非法捕魚，保障台灣漁民權益，內政委員會初審通過條文取消不同船種不同裁罰標準，明定中國大陸船舶違反規定經扣留者，得處船舶所有人、營運長或船長、駕駛人30萬以上1000萬元以下罰鍰，並由海岸巡防機關訂定裁罰標準並執行。
